1. Acceptance of Terms
These Terms & Conditions govern your use of the Fairmount Horse Track website and related pari-mutuel wagering features. By accessing this site, creating an account, or submitting a wager, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and any published wagering rules or promotional conditions. If you do not agree, you must not use the service. We may revise these Terms from time to time to reflect legal, technical, or operational changes. Updated versions become effective when posted unless a different effective date is stated. Continued use after updates means you accept the revised Terms.
2. Eligibility and Account Registration
You must be at least twenty-one (21) years old to use wagering features. You are responsible for ensuring your use is lawful in your location. During registration, you agree to provide accurate and current information, maintain the security of your credentials, and update account details when they change. You may not create accounts for another person, use false identity information, or attempt to circumvent account controls. We may request verification documents to confirm identity, age, and lawful source of funds. Failure to provide required verification may result in restricted access, delayed withdrawals, suspension, or account closure.
3. Wagering Rules and Settlement
All wagers are pari-mutuel and are subject to race status, pool integrity, official race declarations, and published market terms. Odds and pool displays are informational and may change before pool close. A wager is considered accepted only after confirmation appears in your account record. Settlement is based on official race outcomes and steward rulings where applicable. If a race is canceled, postponed, materially altered, or declared void under applicable rules, affected wagers may be refunded, recalculated, or canceled depending on governing pari-mutuel procedures. We reserve the right to correct manifest errors, technical mispricing, or obvious display faults that materially affect a wager outcome.
4. Payments, Deposits, and Withdrawals
Deposits and withdrawals must be made using approved payment channels and in compliance with account verification requirements. You must use payment methods lawfully owned or authorized by you. We may place temporary holds on withdrawals where fraud review, identity verification, anti-money laundering checks, or technical reconciliation are required. You are responsible for ensuring account details used for payouts are correct. Transaction fees, limits, processing times, and method availability may vary and may change over time. We may decline or reverse transactions associated with chargeback abuse, suspicious activity, duplicate requests, or legal restrictions.
5. Prohibited Conduct
You may not use the platform for unlawful activity, account manipulation, credential sharing, unauthorized automation, malicious code injection, or deliberate disruption of service operations. You may not exploit platform bugs, race timing loopholes, or payment vulnerabilities to gain unfair advantage. Coordinated abuse, bonus fraud, and source-of-funds violations are strictly prohibited. We may suspend or terminate accounts, cancel benefits, void affected wagers, and report conduct to relevant authorities where required by law.
6. Promotions and Bonus Conditions
Promotions are subject to eligibility rules, expiry periods, and specific terms posted with each offer. Unless explicitly stated, promotions are not transferable, not redeemable for cash, and limited to one per qualifying account, person, payment instrument, household, or device group. We may modify or withdraw promotions where misuse, legal risk, or operational conflict exists. Bonus balances may be restricted to designated wagering uses and may expire if not used within the stated period.
7. Limitation of Liability
The service is provided on an as-available basis. While we strive for continuity, we do not guarantee uninterrupted access, error-free operation, or permanent availability of any feature. To the maximum extent permitted by law, we disclaim liability for indirect, incidental, consequential, or punitive damages arising from platform use, delays, outages, or third-party payment failures. Nothing in these Terms excludes liability that cannot be excluded by applicable law.
8. Governing Law and Contact
These Terms are governed by applicable United States and Illinois laws, together with rules that apply to licensed pari-mutuel operations. Any dispute should first be submitted to customer support for resolution. If unresolved, the parties may pursue available legal remedies in the appropriate jurisdiction.
